While these functionalities represent the core of the Service, any other features not explicitly described are outside the scope of these Terms, and Rootlenses does not guarantee their availability or performance.
The Service operates exclusively on the data provided by the user or their organization, and does not access external systems or databases beyond what is explicitly authorized. Users understand that the AI relies on this input to generate outputs and that Rootlenses cannot control, and is not responsible for, errors or omissions that may occur as a result. The Service is intended to support business decision-making and operational efficiency, but it is not a substitute for professional judgment or independent verification.
By using Rootlenses Voice, users acknowledge that they understand the limitations of the Service, including the scope of functionality, the restricted access to data, and the possibility of AI-generated errors, and agree to operate the Service within these parameters.
Eligibility

If accessing the Service on behalf of a company or other legal entity, users confirm that they have the authority to bind that entity, its affiliates, and all users accessing the Service through their account to these Terms. Access may be denied or revoked if a user does not meet these requirements, or if providing the Service would conflict with any law, regulation, or internal policy.
By using Rootlenses Voice, users acknowledge that they meet the eligibility requirements and agree to operate the Service within the defined legal and operational parameters.
Service Setup and Configuration
The deployment of Rootlenses Voice begins with a collaborative process to ensure the service is fully tailored to the client’s needs. This starts with an initial meeting to understand the requirements, followed by a technical review of the client’s existing infrastructure to assess feasibility and identify any adjustments necessary for seamless integration.
Depending on the complexity, we may provide an estimate of modifications or enhancements required, including API integration and database quality checks, as well as a technical support allocation through a dedicated hours package. Once the groundwork is completed, a kick-off is scheduled to initiate the configuration process.
During setup, we configure the assistant within the OpenAI platform, defining a specific output format and generating an API key with access to the models currently in use. A template is created, which includes its RAG files, Chain of Thought (CoT), and three ETL scripts, establishing the structure for automated calls and data handling.
Following template creation, we define the settings for the frequency and scheduling of cron jobs, ensuring that the assistant operates according to the agreed schedule. Once these parameters are set, the template is enabled and prepared for execution.
The next step involves adding a vendor, such as Twilio, and configuring all associated phone numbers to be used for outgoing calls. The system is then monitored as it executes the calls, capturing transcriptions, summaries, and sentiment insights, allowing the client to evaluate engagement and outcomes in real time.
Through this process, Rootlenses Voice is configured to operate efficiently and securely, providing a fully functional AI-powered calling solution that aligns with the client’s operational needs.
Service Level Agreement (SLA)
Rootlenses Voice is committed to providing a reliable and high-performing service. The following outlines our operational standards and support expectations:
Service Availability (Uptime)
- Availability Commitment: Rootlenses Voice guarantees a service uptime of 99.9% per month, equivalent to a maximum of 43.2 minutes of unplanned downtime per month.
- Scheduled Maintenance: Planned maintenance will be communicated at least 72 hours in advance and scheduled outside of peak hours to minimize user impact.
Support Response Times
- Critical Incidents: Initial response within 30 minutes during business hours.
- High-Priority Incidents: Initial response within 4 hours.
- Standard Incidents: Initial response within 1 business day.
- 24/7 Emergency Support: Available for critical incidents outside of standard business hours.
Service Failure Remedies
- Service Credits: If uptime or response time commitments are not met, users may request service credits equal to 5% of the monthly service fee for each 30 minutes of unplanned downtime or for each critical incident not resolved within the committed timeframe.
- Claim Process: Requests for service credits must be submitted in writing within 10 business days of the incident.
SLA Exclusions
- Force Majeure: The SLA does not apply in cases of force majeure, including natural disasters, acts of terrorism, or third-party service failures beyond Rootlenses’ control.
- User-Caused Incidents: The SLA does not cover interruptions or issues caused by misuse of the service, incorrect configurations, or unauthorized modifications by the user.
Monitoring and Reporting
- User Dashboard: Users have access to a real-time dashboard to monitor service status, including availability metrics and support ticket updates.
- Monthly Reports: Rootlenses provides detailed monthly reports on service performance, including uptime statistics and support response metrics.
Intellectual Property Rights and Licenses
All intellectual property rights in Rootlenses Voice, including its models, templates, RAG files, Chain of Thought (CoT), ETL scripts, and any other associated software or materials, are exclusively owned by Rootlenses and its affiliates. This ownership extends to any improvements, updates, or modifications developed by Rootlenses.
When we configure and deploy the Service for a client, users are granted a limited, non-exclusive, non-transferable, and revocable license to access and use Rootlenses Voice solely in accordance with these Terms. This license does not convey any ownership rights and is restricted to the intended purposes defined during setup and configuration. Users are strictly prohibited from copying, modifying, distributing, reverse engineering, or creating derivative works based on the Service without prior written authorization from Rootlenses.
The Service may integrate with third-party technologies, including but not limited to OpenAI and Twilio. Your use of these components is subject to the respective third-party terms and conditions, and Rootlenses does not assume ownership or liability for those external services beyond what is necessary to deliver Rootlenses Voice.
All data uploaded or generated by the user through the Service remains the property of the user or their organization. Rootlenses does not claim ownership over user data, but it retains rights over the underlying software, frameworks, and configurations that enable the Service to operate. Users are responsible for ensuring that any content they provide does not infringe upon the rights of third parties or violate applicable laws.
By using Rootlenses Voice, users acknowledge and agree to respect these intellectual property rights and to operate strictly within the scope of the license granted, understanding that any unauthorized use may result in suspension of access or legal action.
User Responsibilities and Compliance
Users of Rootlenses Voice are expected to operate the Service responsibly, ethically, and in accordance with all applicable laws and regulations. Rootlenses Voice ensures that user data remains secure and is used only as configured within the Service, and users are expected to uphold similar standards of confidentiality and ethical conduct.
By using Rootlenses Voice, users agree to comply fully with these responsibilities, understanding that violations may result in suspension of access, revocation of the license to use the Service, or legal action. These responsibilities form an integral part of the Terms and Conditions, designed to safeguard both the Service and the interests of its users.
Input & Output / Restricted Input Content
Users are responsible for the content they input into the Service and for the proper use of the output generated. The Service is designed to process inputs and deliver outputs according to the templates, scripts, and configurations established during setup. Users must ensure that the content they provide does not violate any applicable law, regulation, or the rights of any third party.
Restricted Input Content includes, but is not limited to, content that may cause physical or mental harm, emotional distress, death, disability, disfigurement, or illness; content that exploits or harms children; content that solicits personally identifiable information in a manner that may constitute or contribute to illegal activity; and content that is unlawful, offensive, abusive, harassing, defamatory, threatening, or otherwise objectionable. Users must not provide content that infringes intellectual property rights, violates privacy or publicity rights, or includes information for which they have not obtained necessary permissions. Additionally, content that is false, misleading, adult in nature, or related to unauthorized commercial activities (such as contests, sweepstakes, advertising, or pyramid schemes) is strictly prohibited.
Enforcement and Escalation
Rootlenses will provide written notice to users if their content is deemed in violation of these restrictions, along with an opportunity to cure the violation within 5 business days. Repeated violations or failure to cure may result in escalation, including suspension or termination of access to the Service. Rootlenses reserves the right to disclose information as required to comply with applicable laws, regulations, or official requests.
Users acknowledge that adherence to these restrictions and procedures is essential for the safe and lawful use of the Service and agree to comply fully when providing input or relying on output generated by Rootlenses.
Use of the Service

Third-Party Applications

Any misuse of the Service or input of restricted or prohibited content may result in suspension or termination of access to the Service.
Regarding Customer Warranty, Rootlenses provides the Service on an “as is” basis and does not guarantee results or specific outcomes. While we strive to maintain reliable and secure operations, users acknowledge that AI-generated outputs may contain errors or limitations, and that the Service relies on third-party vendors, APIs, and integrations that may impact performance. Your use of the Service is at your own risk, and Rootlenses disclaims any liability for losses, damages, or claims arising from the use of User Content, AI outputs, or other results obtained through the Service.
By using the Service, you agree to assume all responsibility for the content you provide, the way you use the Service, and any consequences that may arise from relying on the outputs of the AI, while Rootlenses commits to providing the Service in accordance with its technical and operational capabilities.
Warranty
Rootlenses provides the Service on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
While Rootlenses strives to maintain the Service operational, reliable, and secure, no specific uptime or availability guarantee is provided. Users are responsible for evaluating the suitability of the Service for their own business and technical needs, and any reliance on outputs, recommendations, or integrations provided by the Service is at the user’s sole risk.
Rootlenses employs state-of-the-art technology and may implement updates, improvements, or modifications to ensure continued performance, security, and reliability, without creating additional warranties.
We do not guarantee that third-party integrations, vendors, or APIs used in connection with the Service will remain compatible, available, or free from issues.
To the fullest extent permitted by law, Rootlenses expressly disclaims any liability for losses, damages, or claims arising from the use of the Service, including system interruptions, security breaches, data loss, or inaccuracies in AI-generated content, and acknowledges that the Service is continuously evolving, with features, functions, and availability subject to change at Rootlenses’ discretion.
Limitation of Liability
Rootlenses shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, revenue, or business opportunities, arising out of or in connection with the use of the Service.
Notwithstanding the foregoing, Rootlenses will accept limited liability for direct damages caused by its gross negligence or willful misconduct, subject to a maximum aggregate liability not exceeding the total fees paid by the user for the Service in the twelve (12) months preceding the claim.
Rootlenses is not responsible for any personal injury, property damage, or other harm resulting from unauthorized access to secure servers or information, including personal or financial data, nor for errors or losses resulting from third-party applications or integrations. Interruptions, transmission failures, or technical issues, including bugs, viruses, or other harmful code introduced by third parties, are not covered.
The total liability of Rootlenses, its affiliates, employees, agents, and licensors shall not exceed the maximum amount specified above, regardless of the legal theory or basis of the claim. Certain jurisdictions may not allow the exclusion or limitation of incidental, consequential, or implied damages, or may impose stricter rules regarding gross negligence, and nothing in these Terms shall be construed to limit liability to the extent prohibited by applicable law.
Force Majeure
Rootlenses Voice shall not be liable for any failure or delay in performance of the Service caused by events beyond its reasonable control, including but not limited to natural disasters, acts of government, strikes, or technical disruptions affecting AI model availability or API access. Indemnification
User agrees to indemnify, defend, and hold harmless Rootlenses Voice, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in connection with User's violation of these Terms, misuse of the Service, or violation of applicable law.
Artificial Intelligence Disclaimer

The Service is intended to augment human capabilities, not replace human judgment or supervision. For international users, Rootlenses also adheres to GDPR and CCPA where applicable.
User Rights: Users have the right to access, rectify, erase, or export their personal data. Requests must be submitted in writing and will be addressed within 30 business days.
Retention and Deletion: User data is retained for no longer than necessary to provide the Service or to comply with legal obligations. Upon request or at the end of the retention period, data will be securely deleted or anonymized.

Call Recording and Consent: Users are responsible for ensuring compliance with applicable call recording laws, including two-party consent requirements in certain U.S. states. Rootlenses will notify users of recordings and provide tools to manage consent.
International Data Transfers: For cross-border transfers, Rootlenses implements contractual and technical safeguards to ensure an adequate level of data protection in accordance with GDPR and other applicable international privacy laws.
Data Breach and Security: Rootlenses employs industry-standard technical and organizational measures to protect against unauthorized access, disclosure, alteration, or destruction of data. Users must report any suspected security incidents promptly. Rootlenses will investigate and mitigate breaches in accordance with applicable law.
By using Rootlenses Voice, users acknowledge and accept these data protection practices, understanding their rights and responsibilities under U.S. and international privacy frameworks.
Telecommunications & Voice Data Compliance
Rootlenses Voice involves the transmission and recording of voice communications, which are subject to specific legal and regulatory obligations. This section outlines the responsibilities of users regarding telecommunications compliance, call recording consent, and the protection of voice data to ensure lawful and secure use of the Service.
Telecommunications Compliance: Users are solely responsible for obtaining all necessary consents before initiating calls and for compliance with the Telephone Consumer Protection Act (TCPA), Do Not Call (DNC) registries, and all other applicable telecommunications laws and regulations.
Recording Consent: Users must ensure compliance with all applicable laws regarding call recording consent, including one-party or two-party consent requirements depending on jurisdiction, and must configure appropriate disclosures to all parties.
Voice Data Security: Users acknowledge that voice recordings may constitute sensitive biometric or personal data in certain jurisdictions. Rootlenses applies technical and organizational security measures to protect stored voice data, but users remain responsible for the lawful collection, storage, and processing of call recordings.
Confidentiality
Rootlenses acknowledges that in the course of providing the Service, it may receive or have access to confidential or proprietary information belonging to users. Such information will be treated with strict care and will not be disclosed, shared, or used for any purpose other than delivering and maintaining the Service, except where disclosure is required by law, regulation, or court order. Reasonable technical and organizational safeguards are implemented to protect this information against unauthorized access, loss, or misuse, consistent with industry standards.
Users are equally responsible for maintaining the confidentiality of any credentials, access keys, or sensitive data shared through the Service.
